ARVADA, Colo. – GD Licensing, Inc., formerly Great Divider Golf, Inc., the company who patented the 14-way two-color divider system, has reached a settlement on a patent infringement with Sun Mountain Sports.
"The terms of the settlement will remain undisclosed," said Jim Sutter, President of GD Licensing, Inc. "Sun Mountain will continue marketing and selling golf bags with two color tops under a licensing agreement with GD Licensing, Inc."
Sutter, the founder of Great Divider and the inventor of the modern 14-way two-color top divider has been semi-retired since having sold the company last fall.
"The lawsuit with Sun Mountain was one of the last responsibilities I had to take care of associated with the sale of Great Divider. Now with this behind me I can start looking for new opportunities within the golf industry," he said.
Great Divider Golf, LLC, the company that purchased the parent company Great Divider in the fall of 2006 retains full rights to the use and licensing of the two color top to all other companies. The legitimacy of the patent was stressed in a statement made by Joseph Erwin, President of Great Divider Golf, LLC.
"The settlement with Sun Mountain and the previous settlement with Datrek, clears up any confusion on the legitimacy of the patent," Erwin said. "It’s our objective to strictly enforce the two-color top patent. We are not opposed to licensing other companies; however, we believe the two-color top patent is a valuable asset that must be protected."
