PORTLAND, Maine – A golf simulation company owned by Maine entrepreneur Les Otten received a favorable decision Tuesday in the U.S. District Court in Portland, Maine on a patent infringement case the company filed against a competitor’s product to analyze a golfer’s swing.
Judge D. Brock Hornby ruled that Eden Technologies of Traverse City, Michigan, makers of Dancin’ Dogg, (www.dancindogg.com) had infringed a patent held by Golf Tech, LLC, of Bethel, makers of P3ProSwing, (www.p3proswing.com) which is owned by Otten. The judge granted summary judgment in favor of Golf Tech on four out of five allegations of patent infringement, and ruled that all the asserted patent claims were valid. The next step in the matter will be a trial to assess damages. Judge Hornby advised both parties to be ready for trial by May 4, 2009.
